The following are notices of DDOE public notices and hearings regarding various environmental issues.
2008 Construction Grant Project Priority List:
Proposed CSX Settlement
On November 9, 2007, eight CSX railcars derailed on a line over the Anacostia River. Six of the cars, containing an estimated 600 tons of coal, fell into the river. This incident is alleged to constitute one or more unpermitted discharges of pollutants into District waters, in violation of the District’s Water Pollution Control Act.
CSX immediately began a cleanup process directed by DDOE, and assisted by various federal agencies. CSX and DDOE monitored water quality on a daily basis. Cleanup and environmental protection efforts concluded in March 2008. As part of the proposed settlement, the railroad will pay $660,561.69 in penalties, expense reimbursements and to create an Anacostia River Endowment Fund.
The proposed consent decree* is open for public comment until the close of business October 14.
Emergency & Proposed Rulemaking to Amend the District's Pesticides Regulations
This emergency action is necessary to protect the public further from potential pesticide hazards, in anticipation of the effective date of the Loretta Carter Hanes Pesticide Consumer Notification Amendment Act of 2008 ('Act'), signed by the Mayor on April 14, 2008 (DC Act 17-342;_DCR_). Section 2 of the Act requires DDOE to: (1) establish a uniform statement and format for the sign that is to be posted at the time of an exterior pesticide application (e.g., lawn spraying); and (2) promulgate a list of reduced-risk pesticides and methods of pest control that will be made publicly available and referenced in a mandatory public notification.

Certification of Nationwide Permits
The purpose of these public notices is to solicit comments from the public about proposed work in the District of Columbia. At this time, no decision has been made as to whether or not a permit and water quality certification will be issued. Provide all your comments during the comment period for each project.
